The October 7 meeting is the first time the Board will discuss Schedule III as part of a board meeting, and the first opportunity to comment on Schedule III to the Board on the official record.
LCB staff have recommended that the Board deny the petition at that meeting. Answer a few questions and this page drafts a letter in your own voice asking the Board to begin rulemaking instead. Read it over, change anything you like, then copy it into an email to the Board.
LCB staff have recommended that the Board deny the petition at its October 7, 2026 meeting. The recommendation acknowledges that the Board likely has the authority to verify medical cannabis participation. It raises concerns about the three-tier system, what the agencies' records contain, staffing, and federal standards, and it offers no other way for licensees to get this documentation.
The Cannabis Alliance is asking the Board to begin rulemaking instead, where those concerns can be worked out, or to defer action so a narrower proposal can be developed.
The Cannabis Alliance's petition, dated August 13, 2026, proposes a Medical Cannabis Verification Certificate based on the Board's official records, a designated point of contact, coordination with the Department of Health when needed, and a response within 15 business days of a complete certificate request.
The proposed certificate would document existing state-authorized activities. It would not create a new license or endorsement, determine federal program eligibility, or certify compliance with federal law.
